Abstract

Fulton County Department of Public Works has submitted to the Department of Natural Resources a construction plan for the Chattahoochee River Long Island interceptor sewer project. Review of this plan has been completed by appropriate DNR staff personnel, with the conclusion that the plan constitutes a reasonable approach for meeting the specific terms and conditions included in the revocable license agreement. It has been understood throughout the revocable license negotiations, by both the State and the County, that other Federal and State legal requirements, not necessarily included in the specific terms and conditions, must also be met by Fulton County.

Specifically, the State will be unable to approve the revocable license until it is satisfied that such a license will not result in an adverse effect to cultural resources including archaeological sites lying within or adjacent to the construction zone. Such adverse effects are defined by the State Antiqu1ty Act, the Nat1onal Preservation Act, and the procedures, regulations, and rules promulgated to implement these laws. An archaeological report has been transmitted to the Department which appears to be the product of an effort designed to comply with these state and federal laws. However, the report is unacceptable for the purpose for which it was apparently intended. It does not meet the draft standards January 1977 or conducting archaeological assessments and assessment results circulated by the Office of the State Archaeologist, Georgia Department of Natural Resources. Beyond this inadequacy, the report can be seriously questioned with respect to the absence of a professionally acceptable record of the work performed.
