Abstract

Pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act, a future application will be made to the Department of the Army Corps of Engineers by Sea Palms Development Corporation of St. Simons Island, Georgia for a permit to construct a marina project in the Frederica River. Sea Palms desires to provide a schematic project program description and applicable existing documentation to the U.S. Army Corps of Engineers and the State of Georgia (Georgia Coastal Marshland Protection Committee and Department of National Resources) to expedite preapplication coordination prior to actual preparation and submittal of a permit application. ,Sea Palms recognizes that due to the close proximity of the proposed Project to the Fort Frederica National Monument, the Corps must ascertain under Section 106 of 36 CFR Part 800 the affect of the proposed Marina project upon the Fort. To that end, Sea Palms desires to cooperate fully with the Corps to utilize the Section 106 process as a means to identify and, hopefully, mitigate potential conflicts between the Fort and the proposed marina project and to resolve such potential conflicts in the public interest. By making this "preapplication submittal" Sea Palms wishes to identify potential conflicts early using the Section 106 consultation process then reconcile the interest of the affected parties to the fullest extent possible before making the actual permit application. Sea Palms desires, within reason, to assist the Fort in its desire to achieve the goals as set forth in Attachment VI, the "Land Protection Plan". To this end, early implementation of the Section 106 consultation process will allow reconciliation of potential conflicts between consulting parties through coordinated mitigation and the mutual development of alternatives which will avoid and/or reduce potentially undesirable effects resulting from implementation of the proposed project. This "Preapplication Submittal" will initiate desired early consultation between consulting parties and formulate mutually acceptable alternatives and/or mitigating measures consistent with Section 106 objectives.
